You also agree not to post any copyrighted material unless you own the copyright or you have written consent from the owner of the copyrighted material. The Music Industry Insiders Additional and Specific Terms of Service (TOS):

We are dedicated to the idea of "commercial songwriting."  We are focused on techniques and styles of writing songs that are, or could be considered "mainstream" meaning the majority of general audiences for any type of musical genre, can easily understand the songs we write.  Music is an amazing journey and we want to share our experiences with our members and help them be as productive as possible.

Member/UserNames/IDs:  We ask that forum usernames contain no profanity, obscene or offensive language.  We reserve the right to ban or delete such member accounts.

Member/Accounts:  The Music Industry Insiders has the right to maintain certain information throughout the site such as areas that are considered community participation, forum posts, photo gallery comments, etc.

Accounts that are deemed to be created for the sole purpose of advertising or spamming will be deleted without warning or notification at our discretion.

We require a current and valid email address for every user.  We also require members to provide their real names in their member profiles.  Members who provide false or incorrect email addresses, or provide email addresses that are deemed to be ‘spam’ related will be banned from the site without notice or communication.

Member/User Conduct:

Members/Users will not use this community for:

Ø       Posting any comments or material that could lead to any civil or criminal liability under the law.

Ø      Personal attacks, destructive, abusive, defamatory communications in any form, or retaliatory attacks from personal attacks. If you need assistance, please communicate with an Administrator or Moderator.

Ø       Any communications made with the intent to disrupt or attack the site. This applies to any communications within this community.

Ø       Advertising or linking to any publications and/or web sites that are age restricted due to content and/or pornographic in nature.

Members/Users found practicing these behaviors receive:

Ø       Deletion of the post(s).

Ø       First event - warning by forum post, site mail/message, email, chat or telephone call.

Ø       Second event – Banned from the site.

We have a very low tolerance level for those who we believe wish only to debate or create arguments.  We welcome all members to share their points of view respectfully and to also share their own songwriting experiences and techniques which may vary from our own.  In doing so, we ask that the tone of communications remain respectful at all times.  It is very important to us to maintain a respectful and productive atmosphere.

Conduct - Zero Tolerance:

The Music Industry Insiders maintain a Zero Tolerance on certain behaviors within the community. These include, but are not limited to the following:

Ø       Any threats of physical harm, property damage or acts of violence toward another individual, or group of individuals.

Ø       Fraudulent use of credit cards or refusing to pay for items or services received.

Ø       Soliciting or trading of any products illegally.

Ø       Creating accounts or memberships for the sole purpose of solicitation of any products or services whatsoever.

Ø       Intentional practices that affect the normal operations of the site or forums.

Members/Users found practicing these behaviors will immediately have their membership revoked, and access from any and all accounts, including duplicate accounts for the same person will be permanently banned from the community. If necessary, the proper legal authorities will be contacted, and if appropriate, charges may be filed.

Communications:

We provide several communication services to our members. These currently include: forums, chat and site mail. Any information provided by members using these services is considered public information and may be logged. We will not be held responsible and/or liable for information that members choose to share via these services. We strongly recommend that members exercise forethought and caution prior to disclosing any personal information while using these services.

Spamming members via any of these devices is prohibited. If you have a service you want to promote, please do so in our Forums where members can choose to review your services if they are interested. Products or services promoted anywhere on the site or links to such, including but not limited to forums, site mail or signature sections of member forum options, may be deleted at our discretion with no warning or notification.

Privacy Statement:

The Music Industry Insiders maintains a database of member/user information to facilitate the community's operations for members, users and administrators. The following discloses our information collection, use and dissemination practices:

Ø      E-mail Addresses: Member e-mail addresses are stored in a database for use in distributing member selected communications and/or newsletters. This information is not shared except in cooperation with appropriate authorities in the case of violations of our Zero Tolerance Conduct.

Ø       IP addresses: Member/User IP addresses are collected, and stored in a database to help diagnose, track, and manage issues within the community. This information is not shared except in cooperation with appropriate authorities in the case of violations of our Zero Tolerance Conduct.

Ø       Purchasing Data: The Music Industry Insiders maintains a database of merchandise or service purchases. Purchasing Data consists of, but is not limited to Name, Address, Phone numbers and email. We do not keep a database of credit card numbers. This information is not shared except in cooperation with appropriate authorities in the case of violations of our Zero Tolerance Conduct.

Ø      Cookies: The Music Industry Insiders Servers are programmed to read, and write member/user specific cookie files. The use of these files is limited to page views and stored information provided by the member. This includes member passwords, purchasing data, and aggregate data. Please note that any data other than that contained in The Music Industry Insiders cookie files cannot be read off your hard disk.

Ø      Aggregate Data: The Music Industry Insiders collects and uses aggregate data for the purpose of advancing the site and soliciting advertisers. This data includes page views, ad impressions, click throughs, total membership and total number of subscribers. No individual personal information is shared with this statistical data.

Ø      Off-Site Links: The Music Industry Insiders community may contain links to a variety of other web sites. These are usually in the form of product advertisements, and/or member/user provided links. The Music Industry Insiders cannot and will not be held responsible for the privacy practices, or content of any web site other than our own.

By visiting The Music Industry Insiders website, you agree that the laws of the State of Georgia, without regard to principles of conflicts of laws, will govern the Terms of Service and a dispute of any type that may arise between you and The Music Industry Insiders in connection with your use of the website. In addition, you agree that any legal action that may arise between you and The Music Industry Insiders in connection with your use of the website shall be brought exclusively in the Superior Court of Cobb County, to which you submit to the exclusive jurisdiction and venue thereof. You further agree that in the event litigation ensues over the Terms of Service and your use of the website, the prevailing party in any such litigation shall be entitled to recover all costs and expenses, including, but not limited to, reasonable attorney's fees, court costs and attendant expenses, from the non-prevailing party.
